REGULAR MEETING MINUTES
AUGUST 20, 2026, 7:00 P.M.
A Regular Meeting of the Elm Creek Village Board of Trustees was convened in open and public session at the Elm Creek Village Center, 535 W. Boyd Avenue, Elm Creek, Nebraska at 7:00 p.m. on August 20, 2026. Advance Notice of this meeting was given in advance thereof by posting of Notice in three public places within the Village as shown in the Certificate of Posting affixed to these minutes. Advance Notice was simultaneously given to the Chairman and all members of the Board of Trustees and their acknowledgment of receipt of Notice and the agenda are affixed to these minutes. Tanner Tool called the meeting to order at 7:00 p.m. by calling for the roll with the following members responding: Tanner Tool, Davis Miner, Michael Strong, Brian Florell, and Alex McDaniel. Tanner announced that in accordance with Section 84-1412 of the Nebraska Revised Statutes, a current copy of the Open Meetings Act is available for review and is posted on the east wall of the meeting room.
CONSENT AGENDA
It was moved by Tanner and seconded by Davis to approve the Consent Agenda consisting of the minutes of the Regular Meeting on July 14, 2026, and the Claims for the month of August in the amount of $253,422.80. Ayes: Brian, Alex, Davis, Michael, and Tanner. Nays: none. The motion carried.
AGENDA ITEM #1: Presentation from Five Rule Rural Planning for a housing study
Bobbi Pettit and Jordan Wong were present. Bobbi gave an overview of her company and what they do for communities like Elm Creek. Bobbi will lead the Community Engagement and Implementation strategy. This will help capture the attitude of the residents to make sure we are going in the direction they wish to see for Elm Creek. They will hold community workshops as early as September and then compile all the data and present their study no later than December 1, 2026.
AGENDA ITEM #2 Consider and approve a housing study
The Village of Elm Creek had their last housing study in 2019. To move forward with residential development and to utilize tax increment financing, we need an updated study. Dusty had contacted 3 planning agencies to get quotes for a housing study and Five Rule Rural Planning was the most fiscally responsible.
It was moved by Tanner and seconded by Michael to approve Five Rule Rural Planning for a housing study in the amount of $16,000. Ayes: Alex, Brian, Davis, Tanner, and Michael. Nays: None. The motion carried.
At this time Tanner Tool excused himself as chairman for the following 3 agenda items.
AGENDA ITEM #3: Consider and approve the proposed utility plan for Rose Estates
Lance with Oak Creek Engineering presented infrastructure options. The plan estimate is $230,000 and includes a 15% contingency. This item was tabled until after the planning commission meets and gives their recommendation.
AGENDA ITEM #4: Discuss and approve who pays for the utility plan for Rose Estates
This item was tabled until after the planning commission gives their recommendation.
AGENDA ITEM #5: Discuss Bond Street access for proposed subdivision
The options are either a private drive or public alley. Tanner asked the engineer to put plans for an alley in the plat for the planning commissions review. No action taken by the board.
SHERIFF’S REPORT:
Sergeant Andersen reported that scooters & e-bikes continue to be an issue around the county. There are now electric motorcycles and they are not legal. Enforcement options were discussed as we do have an ordinance in the Village of Elm Creek.
AGENDA ITEM #6: Approve and authorize the signing of the Municipal Annual Certification of Program Compliance to the Nebraska Board of Public Roads Classifications and Standards 2026 by Resolution.
Tanner introduced and read in full Resolution 2026-4. It was moved by Tanner and seconded by Brian to approve Resolution 2026-4 to approve the signing of the Municipal Annual Certification.
Ayes: Brian, Tanner, Michael, Davis, and Alex. Nays: none. Absent: The motion carried.
Tanner Tool presented his development proposal and his plan for using TIF to help fund it. There will be 8 single family lots that will have a 1300 sq foot house and a 2-car garage. 1 of the lots is already spoken for, and he is ready to build it when he gets approval.
DEPARTMENT REPORTS
Dusty gave an overview of the 26-27 budget worksheets from AMGL P.C. They are suggesting that we do a debt service request to cover the 2022 bonds and to increase our levy by 15%.
We received notice that NPPD will raise rates by 8.6%. We are going to look at increasing our franchise fee income by 0.5% per agreement with NPPD.
Prior to the September meeting we will review the fee schedule to see if there are any rates that need increased.
Alex asked what can be done about the unlicensed or expired registration vehicles that are parked along the railroad. Dusty will talk to the Sheriff’s office about them.
Due to fall sports our next meeting will be held on Tuesday, September 15 at 6:30.

All agenda items having been considered, it was moved by Alex and seconded by Brian to adjourn this Regular Meeting. Ayes: Tanner, Michael, Brian, Davis, and Alex. Nays: none. The motion carried and the meeting was adjourned at 8:36pm.
