REGULAR MEETING MINUTES
JUNE 18, 2026, 7:00PM

A Regular Meeting of the Elm Creek Village Board of Trustees was convened in open and public session at the Elm Creek Village Center, 535 W. Boyd Avenue, Elm Creek, Nebraska at 7:00p.m. on June 18, 2026. Advance Notice of this meeting was given in advance thereof by posting of Notice in three public places within the Village, as shown in the Certificate of Posting affixed to these minutes. Advance Notice was simultaneously given to the Chairman and all members of the Board of Trustees and their acknowledgment of receipt of Notice and the agenda are affixed to these minutes. Tanner Tool called the meeting to order at 7:01 p.m. by calling for the roll with the following members responding: Tanner Tool, Davis Miner, Michael Strong, and Kyle Lawrence. Absent: Brian Florell. Tanner announced that in accordance with Section 84-1412 of the Nebraska Revised Statutes, a current copy of the Open Meetings Act is available for review and is posted on the east wall of the meeting room.

CONSENT AGENDA
It was moved by Tanner and seconded by Michael to approve the Consent Agenda consisting of the minutes of the Regular Meeting on May 21, 2026, and the Claims for the month of June in the amount of $114,327.49. Ayes: Kyle, Davis, Michael, and Tanner. Nays: none. The motion carried.

SHERIFF’S REPORT: Deputy Hall reviewed the sheriff’s report with us and said there was nothing of concern to report.

REGULAR AGENDA

AGENDA ITEM #1: Consider and approve Rick Bauer’s request for EC Cruisers Car Show and street closure August 29, 2026.
It was moved by Tanner and seconded by Kyle to approve the street closure for the EC Cruisers Car Show August 29, 2026. Potter Avenue from Front Street to Tyler Street and Tyler Street from Potter Avenue to Calkins Avenue. Ayes: Davis, Michael, Kyle, and Tanner. Nays: None. The motion carried.

AGENDA ITEM #2: Consider and approve additional bids for street maintenance.
Additional bids were received to do maintenance on McComb Street from Highway 30 north to the school and on the north side of the school to the park entrance. It was moved by Tanner and seconded by Michael to approve the additional bid for McComb Street in the amount of $18,904. Ayes: Davis, Tanner, Michael, and Kyle. Nays: None. The motion carried.
AGENDA ITEM #3: Discussion on water/sewer improvements for new subdivision
Tool Ventures is planning to develop land on N Church/N Bond Streets into a new subdivision. They have hired Lance Harter with Oak Creek Engineering to look at the infrastructure options for tying into existing water and sewer lines. Lance presented 2 options to consider with a potential cost of $200,000 up to $227,000. There will be additional discussions at future meetings.

AGENDA ITEM #4: Consider and approve the sale of the grasshopper mower by resolution 2026-2
Tanner read the resolution in full.

RESOLUTION 2026-2
BE IT RESOLVED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF ELM CREEK, NEBRASKA, that:

SECTION 1. The Village of Elm Creek shall sell the following described personal property to-wit:

1) 2022 Grasshopper Mower 725D6

SECTION 2. The Village of Elm Creek will have the above items listed with Adam Marshall Land & Auction Online Equipment Auction scheduled for Tuesday, July 14, 2026. Individual Equipment will be sold to highest bidders. In-person inspections may be scheduled with Adam Marshall Land & Auction Company at (308) 455-4410. Online bids will be held online at MarshallBid.com on Tuesday, July 14, 2026, on the website of Adam Marshall Land & Auction. Terms of the sale are cash.

SECTION 3. Notice of the sale will be given by publication once in legal newspaper and by posting a notice thereof in three (3) public places in the Village to-wit: the Village Clerk’s Office, Elm Creek Post Office and the Bank, at least seven (7) days prior to July 14, 2026

It was moved by Tanner and seconded by Davis to approve Resolution 2026-2 authorizing the sale of the grasshopper mower. Ayes: Tanner, Michael, Davis, and Kyle. Nays: None. The motion carried.

AGENDA ITEM #5: Kyle Lawrence resignation from the Village Board.
After serving the Village for 16 ½ years Kyle will be moving out of town. He was presented with a plaque for his years of service. A notice will be posted announcing his vacancy as his term ends in December 2026.

DEPARTMENT REPORTS
Figgins Construction will be here in July to perform street maintenance.
We have not heard anymore from Pump & Pantry about their parking lot project.
Tanner is going to be getting bulk patch from a company in North Platte, and we will have Overton Sand & Gravel deliver it to us.
Spartan Roofing redid the roof on the south well house.
The annual water report will be mailed out to all residents next week.
Dusty spoke to the State of Nebraska about KENO again. They said that if we were to create an interlocal agreement with the county we could bring it back to Elm Creek. He also spoke to Lynn from Buffalo County, and they would be interested in an agreement.
The next Library Meeting is July 1 at 7:00pm.
The Clinic is set to open in July.
The Buffalo Stampede Committee is bringing a carnival back this year.

AGENDA ITEM #6: Adjournment
All agenda items having been considered, it was moved by Kyle and seconded by Tanner to adjourn this Regular Meeting. Ayes: Tanner, Michael, Davis, and Kyle. Nays: none. The motion carried and the meeting was adjourned at 7:50p.m.
