REGULAR MEETING MINUTES
OCTOBER 16, 2025, 7:00PM

A Regular Meeting of the Elm Creek Village Board of Trustees was convened in open and public session at the Elm Creek Village Center, 535 W. Boyd Avenue, Elm Creek, Nebraska at 7:00pm on October 16, 2025.  Advance Notice of this meeting was given in advance thereof by posting of Notice in three public places within the Village, as shown in the Certificate of Posting affixed to these minutes.  Advance Notice was simultaneously given to the Chairman and all members of the Board of Trustees and their acknowledgment of receipt of Notice and the agenda are affixed to these minutes.  Tanner Tool called the meeting to order at 7:00p.m. by calling for the roll with the following members responding: Kyle Lawrence, Davis Miner, Michael Strong, Brian Florell, and Tanner Tool.  Absent: None.  Tanner announced that in accordance with Section 84-1412 of the Nebraska Revised Statutes, a current copy of the Open Meetings Act is available for review and is posted on the east wall of the meeting room.

CONSENT AGENDA
It was moved by Tanner and seconded by Kyle to approve the Consent Agenda consisting of the minutes of the Budget Hearing, Special Meeting and Regular Meetings from September 18, 2025, and the Claims for the month of October in the amount of $231,078.67. Ayes: Brian, Kyle, Davis, Michael, and Tanner.  Nays: none.  The motion carried.

SHERIFF’S REPORT
Capt Bob Anderson was unable to attend but reported to Dusty that everything was going well.

REGULAR AGENDA

AGENDA ITEM #1 Consider and approve Ordinance 2025-25: An ordinance of the Village of Elm Creek, Nebraska amending section § 111.15 of the Village of Elm Creek municipal code regarding the local option sales and use tax and changing the Village of Elm Creek’s local option sales and use tax from one percent to one and one-half percent;
It was moved by Tanner and seconded by Davis to suspend the statutory rule requiring that ordinances be read on 3 separate occasions, so that ordinance 2025-25 might be introduced, read by title and adopted at the same meeting. Ayes: Brian, Kyle, Michael, Davis, and Tanner. Nays: None.  The motion carried.

Tanner introduced and read the ordinance by title:
An ordinance of the Village of Elm Creek, Nebraska amending section § 111.15 of the Village of Elm Creek municipal code regarding the local option sales and use tax and changing the Village of Elm Creek’s local option sales and use tax from one percent to one and one-half percent;
It was moved by Tanner and seconded by Davis to approve Ordinance 2025-25. Ayes: Michael, Davis, Tanner, Kyle, and Brian. Nays: None.  The motion carried.

AGENDA ITEM #2: Consider and approve cancelling our Keno agreement with Nebraska Cooperative Government
Per the current agreement we are required to give a 6 month notice to cancel our agreement.  The bar would like to get Keno but would prefer to use a different provider. We have not had Keno for 7 years, but we have continued to pay the state for the license to have it.
It was moved by Tanner and seconded by Brian to send a letter cancelling our agreement with Nebraska Cooperative Government. Ayes: Davis, Michael, Tanner, Kyle, and Brian.  Nays: None.  The motion carried.

 AGENDA ITEM #3: Designate the Kearney Hub as our legal publication of record
Due to the closure of the Beacon Observer we will need to publish our minutes and notices in the Kearney Hub.
It was moved by Tanner and seconded by Michael to designate the Kearney Hub as our legal publication of record.  Ayes: Michael, Tanner, Kyle, Brian, and Davis.  Nays: None.  The motion carried.

AGENDA ITEM #4: Transfer money from CD to General Checking Account

Due to insurance and street repair expenses being paid this month we need to move some money from a CD to our checking account. The CD we are looking to transfer has a balance of $79,922.64. There will be no penalty for early withdrawal.
It was moved by Tanner and seconded by Brian to move CD to the general checking account.
Ayes: Michael, Kyle, Brian, Tanner, and Davis. Nays: None.  The motion carried.

DEPARTMENT REPORTS
The state was out and inspected the sewer systems this week. We are in compliance although there was a question about flood irrigating the field. Dana Peterson will check with the state, but he had informed them of our intent when we opted to do this, and we were approved.  We need to pump out the big lift station.

Stan Ourada wasn’t able to take water from us this summer per our agreement so we will be asking for a refund of the money paid to him.

The school has agreed to let us install water meters to monitor their usage.

The street sweeper sank into the street over by the school so we will clean out the hole it left and patch it.

There are water drainage issues around the school that are causing issues so they need to be looked into.

John Deere brought out a mower for us to demo this week.
Buffalo County put out their road project list and 52nd Road was on the top of the list.  They said that we would be funding the project, but we did not agree to that.  Dusty has been in contact with the county about it.

The Library hours have changed.  Dusty continues to monitor the usage of the library.

All agenda items having been considered, it was moved by Brian and seconded by Kyle to adjourn this Regular Meeting.  Ayes: Tanner, Michael, Brian, Davis, and Kyle.  Nays: none.  The motion carried and the meeting was adjourned at 7:29p.m.
