REGULAR MEETING MINUTES
SEPTEMBER 18, 2025
IMMEDIATELY FOLLOWING SPECIAL MEETING
A Regular Meeting of the Elm Creek Village Board of Trustees was convened in open and public session at the Elm Creek Village Center, 535 W. Boyd Avenue, Elm Creek, Nebraska immediately following the special meeting. Advance Notice of this meeting was given in advance thereof by posting of Notice in three public places within the Village and publication in the Beacon Observer, as shown in the Certificate of Posting affixed to these minutes. Advance Notice was simultaneously given to the Chairman and all members of the Board of Trustees and their acknowledgment of receipt of Notice and the agenda are affixed to these minutes. Tanner Tool called the meeting to order at 7:09p.m. by calling for the roll with the following members responding: Tanner Tool, Davis Miner, Michael Strong, Kyle Lawrence, and Brian Florell. Absent: None. Tanner announced that in accordance with Section 84-1412 of the Nebraska Revised Statutes, a current copy of the Open Meetings Act is available for review and is posted on the east wall of the meeting room.
CONSENT AGENDA
It was moved by Tanner and seconded by Brian to approve the Consent Agenda consisting of the minutes of the Regular Meeting on August 18, 2025, and claims for the month of September in the amount of $189,856.74. Ayes: Kyle, Brian, Davis, Michael, and Tanner Nays: None The motion carried.
SHERIFF’S REPORT: Deputy Andersen was in attendance and said they are continuing to stay present at school events. There was a question asked regarding electric bikes and whether there were any laws pertaining to them. He said that if they have pedals, they are considered a bicycle and there isn’t anything that can be enforced with them.

AGENDA ITEM #1: DISCUSSION/ACTION RE: Consider and approve Personnel Schedule and charge out rates for FY25-26
It was moved by Tanner and seconded by Brian to approve the Personnel Schedule and updated charge out rates for FY25-26. Ayes: Michael, Kyle, Davis, Brian, and Tanner. Nays: None. The motion carried.
AGENDA ITEM #2: DISCUSSION/ACTION RE: Consider and approve FY25-26 Comprehensive Fee Schedule
It was moved by Tanner and seconded by Kyle to approve the FY25-26 Comprehensive Fee Schedule. Ayes: Brian, Tanner, Michael, Kyle, and Davis Nays: None. The motion carried.
AGENDA ITEM #3: DISCUSSION/ACTION RE: Executive Session to discuss KENO
Dusty said it was not necessary to go into executive session, so open discussion was held. The Village currently has an interlocal agreement with the Nebraska Cooperative Government (NCG) out of Columbus for KENO. The Crick Restaurant & Bar is interested in offering KENO and would like to know what their options are and if they must stay with this group. The Crick owner will reach out to NE Lotto and discuss their structure and then the Village will decide if we will continue with our agreement or make a change. If a change is made, we are required to give the NCG a 6-month notice.
DEPARTMENT REPORTS
Figgins Construction was back in town making repairs to their work on E Calkins ave.
TL Sund has begun work on the McComb Street Return, and it should be done early next week.
The utility staff is working on picking up the excess gravel on the streets. We had a resident report that the street sweeper was throwing up gravel on their vehicles. Dusty contacted the insurance company, and they said we could file a general claim and that they would have an adjuster reach out to determine damage.
We have been pumping from the lagoons and plan to do so as long as we can.

All agenda items having been considered, it was moved by Kyle and seconded by Brian to adjourn this Regular Meeting. Ayes: Davis, Michael, Tanner, Brian and Kyle. Nays: none. The motion carried and the meeting was adjourned at 7:48p.m.
