REGULAR MEETING MINUTES

JULY 20, 2023, 7:00 P.M.

 

A Regular Meeting of the Elm Creek Village Board of Trustees was convened in open and public session at the Elm Creek Village Center, 535 W. Boyd Avenue, Elm Creek, Nebraska at 7:00 p.m. on July 20, 2023.  Advance Notice of this meeting was given in advance thereof by posting of Notice in three public places within the Village and publication in the Beacon Observer, as shown in the Certificate of Posting affixed to these minutes.  Advance Notice was simultaneously given to the Chairman and all members of the Board of Trustees and their acknowledgment of receipt of Notice and the agenda are affixed to these minutes.

Tanner Tool called the meeting to order at 7:02p.m. by calling for the roll with the following members responding:  Michael Strong, Tanner Tool, and Kyle Lawrence.  Absent:  Davis Miner & Mike Brown. Tanner announced that in accordance with Section 84-1412 of the Nebraska Revised Statutes, a current copy of the Open Meetings Act is available for review and is posted on the east wall of the meeting room.

 

CONSENT AGENDA

It was moved by Tanner and seconded by Michael to approve the Consent Agenda consisting of the minutes of the Regular Meeting on June 22, 2023, and Claims for the month of July in the amount of $89,152.68.  Ayes: Kyle, Michael and Tanner   Nays: None   The motion carried.

 

SHERIFF’S REPORT:  Captain Bob was unable to attend but sent a note stating that they are prepared for the start of school in August as well as all Stampede events.  They have purchased a new speed trailer and plan to keep it in Elm Creek.

 

REGULAR AGENDA

 

AGENDA ITEM #1: DISCUSSION/ACTION RE:  Consider and approve Rick Bauer’s request for EC Cruisers Car Show and street closure from 4:00pm on Friday August 25 to 8:00pm on Saturday August 26, 2023. 

It was moved by Tanner and seconded by Michael to approve Rick Bauer’s request for EC Cruisers Car Show and street closure from 4:00pm on Friday August 25 to 8:00pm on Saturday August 26, 2023.  The street closures of Potter Avenue from Front Street to Tyler Street and Tyler Street from Potter Avenue to Calkins Avenue.

Ayes: Kyle, Tanner & Michael.  Nays: None.  The motion carried.

 

AGENDA ITEM #2: DISCUSSION/ACTION RE: Discussion on Water Meters with Lance Harter from Oak Creek Engineering

The sewer lagoons have been running at maximum capacity for awhile now.  Installing water meters could potentially help with the issue.  Adding another lagoon cell might also help.  Both options would carry a substantial cost to the Village.  He is going to have a detailed analysis of our usage and a cost analysis prepared for the board to review at the September or October board meeting.

 

AGENDA ITEM #3: DISCUSSION/ACTION RE:  Consider and approve the Personnel Pay Schedule for FY 2023/2024
Dusty proposed a new pay schedule that provides a low and high pay range for each position in the Village.  He talked about the increase to minimum wage and how that impacts our current wages so that was taken into consideration for Fiscal Year 2023/2024.It was moved by Tanner and seconded by Kyle to approve the Personnel Pay Schedule as presented for FY 2023/2024. Ayes: Tanner, Kyle, and Michael.  Nays: None.  The motion carried.

AGENDA ITEM #4: DISCUSSION/ACTION RE: Consider and approve LARM Insurance Renewal
The Village has been pleased with the coverage LARM has provided us in our first 15 months of service. Their rates are increasing but that was expected.  Dusty recommended renewing our policy with them for the next 3 years as they would give us a 5% discount to do so.  Tanner read in full Resolution 2023-4.

LEAGUE ASSOCIATION OF RISK MANAGEMENT 2023-24 RENEWAL RESOLUTION

WHEREAS, The Village of Elm Creek is a member of the League Association of Risk Management (LARM);

WHEREAS, section 8.10 of the Interlocal Agreement for the Establishment and Operation of the League Association of Risk Management provides that a member may voluntarily terminate its participation in LARM by written notice of termination given to LARM and the Nebraska Director of Insurance at least 90 days prior to the desired termination given to and that members may agree to extend the required termination notice beyond 90 days in order to realize reduced excess coverage costs, stability of contribution rates and efficiency in operation of LARM; and

WHEREAS, the Board of Directors of LARM has adopted a plan to provide contribution credits in consideration of certain agreements by members of LARM as provided in the attached letter.

BE IT RESOLVED that the governing body of The Village of Elm Creek, Nebraska, in consideration of the contribution credits provided under the LARM Board’s plan, agrees to:

  • Provide written notice of termination at least 180 days prior to the desired termination date, which date shall be no sooner than Sept 30, 2026. (180 day and 3 year commitment; 5% discount)

Adopted this 20th day of July, 2023.

It was moved by Tanner and seconded by Michael to approve Resolution 2023-4.  Ayes: Kyle, Michael, and Tanner.  Nays: None.  The motion carried.

AGENDA ITEM #5:  DISCUSSION/ACTION RE:  Consider and approve the street closure for the parade route on Saturday, August 19

It was moved by Tanner and seconded by Kyle to approve the street closure for the parade route on Saturday, August 19 from 9:30am to11am on, McComb Street from Calkins to Potter and Potter Avenue from McComb Street to Tyler Street and Tyler Street from Potter Avenue to Elm Avenue.

Ayes: Tanner, Kyle, and Michael.  Nays: None.  The motion carried.

 

AGENDA ITEM #6:  DISCUSSION/ACTION RE:  Consider and approve the street closure for BBQ and Kids Games from 2PM on Friday, August 18 to 8PM Saturday August 19

It was moved by Tanner and seconded by Michael to approve the street closure for BBQ and Kids Games on Tyler Street from the south side of Anita Lane to the North side of Oak Ave from 2PM on Friday, August 18 to 8PM Saturday August 19

Ayes: Michael, Tanner, and Kyle.  Nays: None.  The motion carried.

 

AGENDA ITEM #7: DISCUSSION/ACTION REConsider and approve the street closure for Coons Saloon Street Dance on Saturday August 19 from 4:00pm-1:00am.  100 block N Tyler
It was moved by Tanner and seconded by Kyle to approve the street closure for Coons Saloon Street Dance on Saturday August 19 from 4:00pm-1:00am.  100 block N Tyler
Ayes: Tanner, Michael and Kyle  Nays: None.  The motion carried.

 

AGENDA ITEM #8: DISCUSSION/ACTION RE:  Buffalo Stampede
The stampede committee is making progress.  They have decided on the theme “Get your game on”.  The Fire Department is in charge of the parade and BBQ Competition.  They are working on getting donations for the bounce houses and rides.

 

DEPARTMENT REPORTS

The pool is still waiting on parts for the heater.  A new diving board has been ordered but it will not be here by the end of the season.  The last day the pool will be open is August 6th.
Dusty received a couple of quotes to reseed left field at the baseball fields.  Instead of reseeding the entire left field we may just fix the parts that are torn up and overseed the rest to ensure they are playable next season.  We are still working to fix the outfield lights at the field.  The lights should be in the first part of August. They are still working on the batting cage.  Dusty would like to have all of this completed by the end of this fiscal year.

Tanner would like to see some lighting in the park along the walkways.

The Mill Street improvements are underway and should be completed soon.

The August meeting conflicts with the ECHS Scrimmages so we will hold the August meeting on Wednesday, August 16th at 7:00pm.

All agenda items having been considered, it was moved by Michael and seconded by Kyle to adjourn this Regular Meeting.  Ayes: Michael, Tanner, and Kyle  .  Nays: none. The motion carried and the meeting was adjourned at 8:30p.m.
