REGULAR MEETING MINUTES
MAY 21, 2026, 7:00PM
A Regular Meeting of the Elm Creek Village Board of Trustees was convened in open and public session at the Elm Creek Village Center, 535 W. Boyd Avenue, Elm Creek, Nebraska at 7:00p.m. on May 21, 2026. Advance Notice of this meeting was given in advance thereof by posting of Notice in three public places within the Village, as shown in the Certificate of Posting affixed to these minutes. Advance Notice was simultaneously given to the Chairman and all members of the Board of Trustees and their acknowledgment of receipt of Notice and the agenda are affixed to these minutes. Tanner Tool called the meeting to order at 7:02 p.m. by calling for the roll with the following members responding: Tanner Tool, Davis Miner, Brian Florell, and Kyle Lawrence. Absent: Michael Strong. Tanner announced that in accordance with Section 84-1412 of the Nebraska Revised Statutes, a current copy of the Open Meetings Act is available for review and is posted on the east wall of the meeting room.
CONSENT AGENDA
It was moved by Tanner and seconded by Davis to approve the Consent Agenda consisting of the minutes of the Public Hearing & Regular Meetings on April 16, 2026, and the Claims for the month of May in the amount of $121,563.34. Ayes: Kyle, Brian, Davis, and Tanner. Nays: none. The motion carried.
SHERIFF’S REPORT: Deputy Hall reported that nothing too exciting was happening in the village. Now that all the schools are out, they will be busy monitoring e-bikes and golf cart use. Captain Anderson will be retiring in October and Paul Koerner will be sworn in soon.
REGULAR AGENDA
AGENDA ITEM #1: Marvion & Janet Reichert zoning concerns
The Village has their property surrounding Dollar General listed as commercial on their zoning map and the county has it listed as residential. Her concern is that they did not approve of a zoning change and wanted to know why we changed it. It was decided that when the village did a comprehensive study back in 2019 that they updated it to commercial since they had rezoned the piece that Dollar General had purchased. Tanner Tool told her once they come up with a plan for how the land will be used that we will discuss changing it. For tax purposes what we have listed isn’t affecting it.
AGENDA ITEM #2: Consider the application to rezone a property located at 125 E Potter Ave.
The change would be from residential (R-2) to commercial (C-1). Chad Messersmith was present and stated that he will be utilizing the space for his insurance agency. There have been concerns about changing a residential building to commercial when we have a housing shortage. The property is small and only consists of 1 bedroom.
Having heard all discussion, it was moved by Tanner and seconded by Brian to rezone the property at 125 E Potter Ave from R-2 to C-1. Ayes: Brian, Davis, Tanner, and Kyle. Nays: None. The motion carried.
AGENDA ITEM #3: Consider and approve proposals received for an accounting firm for the annual budget and audit.
We have been with Dana F Cole & Company for the past 10 years. We recently received notice from the state that they had not received our audit. When Dusty questioned the auditor at Dana F Cole, he was told that they got busy and didn’t get it turned in. They did get it submitted after the call and no penalties were incurred. Amy reached out to other
city and village clerks to see who they had used in the past and gave a list to Dusty. Dusty contacted 4 firms for quotes and received quotes back from Dana F Cole & Company LLC and AMGL P.C.. One of the other firms no longer does municipal audits and he did not receive a response from the fourth one. The Quote from AMGL was significantly lower than Dana F Cole & Company so Dusty recommended that we approve them. It was moved by Tanner and seconded by Davis to approve the quote from AMGL. Ayes: Tanner, Kyle, Brian, and Davis. Nays: None. The motion carried.
AGENDA ITEM #4: Consider and approve additional bids for street maintenance.
From the April meeting there was a request for additional bids for McComb St from Highway 30 to the south side of the school and then from the north side of the school to Elm Ave. The additional cost would be $18,904 to the already approved quote of $97,528.00. Dusty then told the board that Pump & Pantry will be doing some work on their parking lot and we could potentially do some curb and gutter work there. We are waiting to hear back from their contractor to see how much it would cost for us to have them do some of the work we need done. We will discuss it further in June once we have a quote. No action taken.
DEPARTMENT REPORTS
The pool is set to open on Tuesday, May 26. It has been filled and they are working to balance the chemicals. The heater will be turned on soon as well. The pool hours will be Monday thru Thursday 1 – 5 and 6 – 8. Friday, Saturday and Sunday open 1 – 5.
The guys have been mowing the town getting ready for Memorial Day weekend. The flags were put up on Wednesday. Steinbrinks have delivered flowers for the pots around town.
The new mower should be here on or before June 8.
We are having a sewer issue up in the park bathroom by the ballfield. Area Services were contacted and are working on it.
Buffalo County has declared the Gibbon parade to be the official parade of the county for the 250th Celebration of USA. They would like each community to appoint a grand marshal to represent them.
Kyle Lawrence will be resigning from the board of trustees as he is leaving Elm Creek. June 18th will be his last meeting.

All agenda items having been considered, it was moved by Brian and seconded by Kyle to adjourn this Regular Meeting. Ayes: Tanner, Brian, Davis, and Kyle. Nays: none. The motion carried and the meeting was adjourned at 7:36 p.m.
